These terms form an agreement between you and BerryMill LLC, a Wyoming limited liability company (“GamesBerry”, “we”, “us”), covering the website at gamesberry.app, the GamesBerry API and everything we publish through them (together, the Service). By using the Service you accept them; if you do not accept them, please do not use the Service.
One point matters more than any other and is repeated in section 7: the revenue and sales figures we publish are modeled estimates, not reported results. Treat them accordingly.
GamesBerry aggregates publicly available information about video games from several storefronts and derives analytics from it: estimated revenue and unit sales, price history, review and follower trends, player counts and store chart positions.
We may change, add or withdraw features at any time. We aim to keep the Service available continuously but do not guarantee uninterrupted access; maintenance, third-party outages and changes made by the storefronts we track can all interrupt it.
Some features require an account. You agree to give accurate information, to keep your credentials confidential, and to be responsible for activity under your account. Tell us at support@gamesberry.app if you believe your account has been compromised.
You must be at least 16 years old to create an account. You may delete your account at any time; see the Privacy Policy for what happens to your data afterwards.
The Service has a free tier and a paid Pro tier. During the launch promotion every Pro feature is available to everyone at no cost; the promotion end date is stated on the pricing page.
Statutory withdrawal rights. If you are a consumer in the EEA or the UK, you normally have 14 days to withdraw from a distance contract. By starting to use Pro immediately you ask us to begin performance during that period and acknowledge that the right to withdraw is lost once the service has been fully performed. Outside that regime we handle refund requests case by case — write to support@gamesberry.app.

Reasonable citation is welcome: you may quote figures and charts in articles, presentations and reports provided you attribute them to GamesBerry, link to the source page where practical, and make clear that revenue figures are estimates.
API access is subject to the rate limits published on the API page, which we may adjust to protect the Service. API keys are personal to your account and must not be shared or embedded in a public client. We may suspend a key that generates abusive traffic, and will tell you why when we do.
The Service — its software, design, text and the analytics we derive — belongs to GamesBerry and is protected by copyright and other laws. These terms grant you a limited, non-exclusive, non-transferable right to use the Service, and nothing more.
Game titles, artwork, screenshots, trailers, trademarks and review text belong to their respective publishers, developers, storefronts and authors. GamesBerry is not affiliated with, endorsed by or sponsored by Valve, Epic Games, GOG, Apple, Google, Sony or Microsoft. We display that material to identify and describe the games we analyse.
If you own rights in material shown here and want it removed, email support@gamesberry.app with the URL, a description of the material and confirmation of your authority to act. We respond to properly formed notices promptly.
This section is the most important one in this agreement. Revenue, unit sales, wishlist figures and similar values on GamesBerry are produced by a statistical model from public signals such as review counts and prices. They are approximations. They are not audited, not supplied by publishers, and not confirmed by any storefront. Real results routinely differ, sometimes by a wide margin.
Nothing on the Service is financial, investment, legal or tax advice, and nothing here is an offer or recommendation to buy, sell or fund anything. If you are making an investment, acquisition, hiring or greenlight decision, do your own diligence and obtain professional advice. Our methodology page sets out how the model works and where it is weakest — please read it before relying on a number.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components, or that any figure it displays is accurate or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, GamesBerry will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service — even if we were advised such damages were possible.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or — for consumers in the EEA and the UK — your non-excludable statutory rights.
If you use the Service in breach of these terms or of the law, you agree to indemnify GamesBerry against claims, damages and reasonable legal costs arising from that use. This does not apply to consumers to the extent local law prohibits it.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these terms, if your use endangers the Service or other users, or if we are legally required to. Where the breach can be fixed, we will normally warn you first. If we terminate a paid account other than for breach, we refund the unused portion of the current period.
These terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The state and federal courts located in Wyoming have non-exclusive jurisdiction over disputes arising from them.
If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you live. Consumers in the EEA and the UK keep their statutory rights and may bring proceedings in their local courts; consumers in the EU may also use the European Commission's online dispute resolution platform.
Before starting any formal process, please contact support@gamesberry.app — most issues are resolved by email within a few days.
We may update these terms as the Service develops. The date at the top always reflects the current version. For material changes we give registered users at least 30 days' notice by email or in the product; continuing to use the Service after that means you accept the new terms.
These terms, together with the Privacy Policy, are the entire agreement between us about the Service. If a provision is held unenforceable, the rest remains in force. Our not enforcing a right is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor in connection with a merger or sale of the business.
